Appellee was charged by indictment with the crime of forgery. The indictment, omitting the formal parts, charges: “That Oliver P. Floyd, on March 8, 1906, at said county and State aforesaid, was then and there the duly elected, qualified and acting trustee of Adams township, Indiana, and ex ojficio trustee of Adams school township, Decatur county, Indiana, and did then and there unlawfully, feloniously, falsely and fraudulently make, forge and counterfeit a certain receipt, purporting to have been made and executed by M.
