Appeal from order of the General Term of the Supreme Court, in the first judicial department, made January 10,1883, which affirmed an order of Special Term, affirming the proceédings óf the commissioners of taxes and assessments of the city and county of New York, in assessing the capital stock of the relator for the year 1880, which proceedings were brought up for review by writ of certiorari. The facts, so far as material, appear in the opinion.

This appeal was argued in connection with the case of The People, ex rel. The Westchester Fire Insurance Company, v. Gideon W. Davenport and other trustees of the Village of New Rochelle, and so far as the questions involved in both cases are identical, was determined by our decision therein. That decision, however, did not embrace all of the questions presented by this appeal and we are, therefore, required to consider such additional questions.
