PRICE, Chief Justice.

Appellee, Mary S. Duncan, hereinafter called plaintiff, on the 22nd day of April, 1938, filed this action in the District Court of Marion County against appellants, Londy Green and his wife Mary Green, hereinafter referred to as defendants.

Count one of plaintiff’s petition was founded on two promissory notes in the respective sums of $250 and $200, said notes being each payable to Andy Elrod, and alleged to have been given by defendant Londy Green in part payment of two described tracts of land in Marion County.
