I. The respondent was charged with the crime of burglary committed November 6, 1898. No question was made by him, but that the burglary was committed at the time and place claimed by the State. He denied having participated in it and his defense was an alibi. In support of this defense, he relied upon certain entries made in a book claimed to have been kept in connection with the livery business of I). H. Sargent at West Lebanon, N. H.
