[¶ 1] Timothy Burns appeals from a judgment of conviction entered by the Superior Court (Aroostook County, Hunter, J.) on one count of theft by unauthorized taking (Class C), 17-A M.R.S. § 353(1)(B)(4) (2007), 1 following a jury trial. 2 Burns also appeals from the sentence imposed by the court. Burns argues that (1) the court erred by not instructing the jury on the jurisdictional amount necessary to establish a Class C offense, (2) the evidence was insufficient to establish his guilt beyond a reasonable doubt, and (3) the court erred by sentencing him for a Class C offense.
