I am unable to agree with the results reached by the majority in this case and I respectfully dissent for two reasons. In the first place, I find nothing in the record before us nor in the decision of the United States Supreme Court in Irvin v. Dowd, 366 U. S. 717, 6 L. Ed. 2d 751, cited and relied on by the majority, which should make the case at bar immune to the rules this court followed long before the United States Supreme Court ever heard of the Indiana case of Irvin v. Dowd.
