Victor, J.), entered October 6, 2005, which, in an action for personal injuries sustained in a fall on the sidewalk abutting defendant-appellant’s property, insofar as appealed from as limited by the briefs, granted defendant’s motion for summary judgment to *264the extent plaintiffs claim against defendant is based on the existence of ice on the sidewalk, and denied defendant’s motion to the extent plaintiffs claim is based on the existence of a crack in the sidewalk, unanimously modified, on the law, to grant the motion in its entirety, without costs.…
