delivered the opinion of the Court:
In March, 1870, appellant Hugh Maher executed to appellee Silverman a note for $10,000, for money loaned him, and' as collateral thereto he executed to him another note for $15,000. To secure the payment of the latter note, he conveyed to Leopold Silverman the premises in question, called the “Bridgeport property.” Subsequently, on January 11, 1871, in substitution of the former, Hugh Maher executed a new note for $15,000 due .at one year with ten per cent interest; also a new deed of trust to Leopold Silverman on the same premises.
