This case involves an oral executory contract under which Leorris Thomas agreed to sell and Bobby Miller (Bobby) agreed to purchase two acres of land located at 149 County Road in Cass County, Texas. Under the terms of the contract, Bobby was to begin paying Thomas’ mortgage on the property, and when the mortgage lien was paid in full, then Bobby would own the property.
