BROOKS, District Judge.

This action was filed on June 10, 1953, in the United States District Court for the District of Columbia. The complaint alleges that the defendants, Brotherhood of Locomotive Engineers and Brotherhood of Locomotive Firemen and Engine-men, had breached their fiduciary duty to fairly represent the interests of the plaintiffs and other members of the same class in the course of collective bargaining.
