The defendant Leroy Turner was convicted of manufacturing liquor, and excepts to the overruling of his motion for a new trial.
The allegation in the motion for a new trial that “the verdict is contrary to evidence and without evidence to support it” is without merit. The evidence that the defendant was out of the State at the time of the alleged commission of the crime was rebutted to the satisfaction of the jury by evidence that the defendant was at the still.
