POWELL, Presiding Judge.

Raymond F. Butler, plaintiff in error, hereinafter referred to as defendant, was charged by information filed in the district court of Tulsa County with the crime of murder, was tried beforé a jury, found guilty and his punishment assessed at life imprisonment in the State Penitentiary. Appeal was perfected to this court on April 29, 1953, but no brief in support of the petition in error has ever been filed.
