MEMORANDUM AND ORDER
OBERDORFER, District Judge.
Plaintiff, the Grand Union Company, brought this action under the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. §§ 1001-1381, as amended by, the Multiemployer Pension Plan Amendments Act of 1980 (MPPAA), 29 U.S.C. §§ 1381-1461 (1982), against a multiemployer pension plan and a number of current members of the Board of Trustees of the plan as well as one former member.
