Separate indictments were returned by the grand jury for the District of South Dakota against Irvin Edward Young and Gilbert Clarence Young, American Indians, on charges of assault with a dangerous weapon in violation of 18 U.S.C. §§ 1153 and 113(c), and first degree burglary in violation of S.D.C.L. § 22-32-1. Both defendants entered pleas of not guilty. On April 29, 1982, the trial court1 ordered the cases consolidated for trial. Trial commenced on May 26,1982.
