The opinion in this case should be read in connection with the opinion in Sebastian County Coal & Mining Company v. Fidelity Fuel Company, Appellant, infra, page 158. Both appeals here arise out of the same record and trial nisi . In fact one appeal is from one portion of a single judgment nisi, and the other appeal is from another portion of such judgment.
