1. This was a suit by Mrs. F. A. Smith against Atlanta Enterprises Inc. and the Constitution Publishing Company, for damages because of injuries to the plaintiff on account of the *761alleged joint negligence of the defendants. The Atlanta Enterprises Inc. filed a demurrer to the petition, which was sustained, and the case was dismissed as to this defendant. The plaintiff excepts to this judgment. A motion to dismiss the bill of exceptions was made by the defendant on the ground that the judgment excepted to was not final and that the case was still pending in the court below, and that the…
