—Appeal by the defendant from a judgment of the Supreme Court, Kings County (Egitto, J.), rendered June 10, 1991, convicting him of murder in the second degree (two counts), robbery in the first degree, and attempted robbery in the first degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

The trial court did not improvidently exercise its discretion in denying the defendant’s motion to dismiss the indictment based, inter alia, on police misconduct (see, CPL 210.40). Although the police admittedly violated certain court orders, the police conduct challenged…
