This matter is before the court on plaintiff’s complaint in assumpsit and de*217fendants’ preliminary objection thereto in the nature of a demurrer.

Under the terms of a written agreement dated July 20, 1948, plaintiffs agreed to sell and convey, and defendants agreed to purchase and pay for certain real estate situated at 1516 Widener Place in the City of Philadelphia, at the price of $13,500.
