In this civil action the plaintiff seeks to recover from the defendant the balance due under an alleged agreement wherein defendant agreed to pay a real estate broker’s commission for procuring a purchaser for its real estate. The defendant pleaded in bar that the absence of a sufficient writing evidencing the alleged agreement constituted a defense under the statute of frauds. It also counterclaimed for the $3,000 deposit paid to the plaintiff as the. defendant’s agent by the purchaser upon execution of the sales agreement.
