Mahnke v. Rice

I agree that the case should be remanded. However, there are several issues on appeal worthy of discussion: whether Mize v. Mize, 621 So.2d 417 (Fla.1993), applies to this case; if so; whether the trial court applied the correct standards under Mize; and whether the trial court erred in prohibiting the presence of court reporters during proceedings held in chambers. Because of my view of Mize, section 61.13(3), and the facts of this case, I disagree with Judge Harris that the trial court should conduct another evidentia-ry hearing.
