delivered the opinion of the court.

This was a suit in assumpsit brought by plaintiff in error against defendant in error upon five bonds of $1,000 each issued by the city of Oquawka.

The declaration contained one special count and the common money counts. The special count alleges that on January 1, 1871, defendant in error was a town organized under the general law then in force; that in pursuance of an act entitled c: An act to authorize the town of Oquawka to subscribe to the capital stock of certain corporations therein named,’1 approved June 1, 1852, and also…
