The relator, claiming that his property has been illegally assessed, brought these proceedings to review the action of the tax commissioners and to have such assassment canceled.

It appears that the property in question was acquired by the city on April 22, 1908, in accordance with the provisions of chapter 4 of the Laws of 1891, known as the Rapid Transit Act.
