WORTENDYKE, District Judge.

Plaintiff is a corporation of the State of New Jersey. Defendant, The Foreg-ger Company, Inc. (Foregger), is a New York corporation, and the individual defendant, Mrs. Foregger, is a resident of the latter State. The Court’s jurisdiction derives from the fact of diversity of citizenship between the parties and the involvement of the minimum jurisdictional amount.
