Defendant was tried by a jury and convicted of forgery, MCLA 750.248; MSA 28.445, and uttering and publishing, MCLA 750.249; MSA 28.446. He was sentenced to serve from 7-1/2 to 14 years in prison.

The testimony of complaining witness, Arlene Bastien, indicated that in the afternoon of September 5, 1970, she cashed a check for $40 for defendant at the D & W Supermarket in Wyoming, Michigan. She specifically recalled observing defendant for a period of approximately ten minutes at the time of the cashing.
