In this weapon’s forfeiture application brought by the Office of the Prosecutor of Cape May County pursuant to provisions of the Prevention of Domestic Violence Act, specifically N.J.S.A. 2C:25-21d(3), the defendant Peter Hand (hereinafter “defendant”) moves for dismissal of the petition at the conclusion of the State’s case based upon (1) absence of specific statutory authority for seizure of authorization papers and (2) failure of the State to petition the court for forfeiture of the item seized within forty-five (45) days of seizure.
