Defendant-Appellant City of New Orleans (the “City”) appeals the district court’s grant of the motion for partial summary judgment filed by Plaintiff-Appellee Paul Davis National, Subchapter S Corporation (“Paul Davis”). We affirm.

I. FACTS AND PROCEEDINGS

The City and DNA Creative Media DNA Media Productions LLC (“DNA Media”) entered into a memorandum of understanding for the construction of a recreation center to be located on the City-owned Comisky Park property.
