This matter is before the Court on Motion by the Defendant, the United States of America (“United States”), to Dismiss all claims against it in Plaintiff Eddie Buchanan’s (“Buchanan”) Amended Complaint (DN 1-3) pursuant to Fed.R.Civ.P. 12(b)(1). DN 5. Fully briefed, the matter is now ripe for adjudication. Having considered the parties’ respective positions, the Court concludes that Plaintiffs negligence claim against the United States must fail for lack of subject matter jurisdiction.
