In October, 1888, the petitioner recovered a judgment in this court against Omer Miller in an action of tort wherein Miller’s body was arrested and Pitkin and Wm. Miller became his sureties by indorsing their names on the writ as bail. The petitioner took the requisite steps to charge the bail, and afterwards brought his writ of scire facias against them, returnable to the May Term, 1890, of this court for Washington County, wherein such proceedings were had that at this present term the bail surrendered the principal into court in discharge of their liability, according to the statute in…
