Rommel Smith appeals his conviction for conspiring to distribute and possess with the intent to distribute 50 grams or more of cocaine base and 500 grams or more of a mixture containing a detectible amount of cocaine and the jury determination he is responsible for 1.5 kilograms or more of a substance containing cocaine base. Smith argues the district court erred by improperly instructing the jury, there was insufficient evidence to support a conviction for the conspiracy charged in the indictment, and his counsel was ineffective.
