This matter is before the court pursuant to the government’s objections to the magistrate judge’s November 14, 1996 Report and Recommendation on Defendant’s Omnibus Motion. The defendant, Mesa Rith, was indicted on February 21, 1996, and charged with unlawful possession of an unregistered sawed-off shotgun in violation of 26 U.S.C. § 5861(d).
