The action in which these appeals were taken was brought by the plaintiff, a physician, and manufacturer and distributor of *439vaccines, residing at Detroit, in the State of Michigan, to recover of the defendants damages which the plaintiff claims to have sustained through a libelous publication concerning the plaintiff and his business, which appeared in “ Hearst’s International Magazine ” in December, 1922, and which magazine was owned, managed and controlled by the defendants.
