This suit involves primarily a question of the proper construction of a written instrument, which, omitting 'signatures, reads as follows:

“This agreement, made and entered into this 17th day of November, A. D. 1908, by and between J. T. Miller, of the county of Stephens and state of Texas, party of the first part, and S. M.
