This was a bill to enjoin the prosecution of an action of ejectment brought by appellee to recover a certain lot in the city of Oarlinville, and to set aside the deed under which appellee claims title to the premises. The court denied an injunction, and dismissed the bill, and this decision is relied upon as error.
The tacts in this case, and in the action of ejectment, Kcester against Burke, Isio. 122 of the present term, are the same, and this opinion is intended for each case.
There is no substantial disagreement between the parties in regard to the facts presented by the record.
