HADEN, District Judge:
This is an appeal from a final order sustaining a judgment entered upon a jury verdict in favor of MePheeters, the driver, and against Dr. Cicinato, the pedestrian. Cicinato claimed compensatory damages for personal injuries sustained in an automobile-pedestrian accident occurring on a lane used by the public within the environs of a privately-owned shopping center.
