William A. Linch departed this life December 24, 1906, leaving surviving him his widow, Arvilla J. Linch, four children by his first and eight children by his second marriage. His last will and testament was admitted to probate. Executors were appointed, and on October 9, 1917, final settlement of the estate was had and accounts of the executors approved and executors discharged. William R. Linch, the appellant, was then appointed successor-trustee, the *707will of William A.
