McENTEE, Circuit Judge.

This is an appeal by the Commonwealth of Massachusetts from a decision of the district court granting appellee’s petition for a writ of habeas corpus *1315which challenged his state court conviction. In April 1970 petitioner-appellee was named in seven indictments, each charging him with knowingly receiving stolen property. He was tried in Suffolk County Superior Court, convicted by a jury on all charges, and was adjudged “a common receiver of' stolen goods.”1 Mass.G.L. c. 266, § 62.
