Abe Gellman & Company sued Jaco Pants, Inc., on four promissory notes attached as exhibits to the petition. Jaco, by and through its attorney, filed an answer denying indebtedness by reason of the fact that the consideration for which the notes were given had totally failed. Thereafter, when the case came on for trial, there was no appearance for the defendant. The plaintiff introduced evidence in support of its petition, and the jury returned a verdict in the amount sued for, plus interest and costs.
