By this proceeding instituted in the Circuit Court of Calhoun County, W. B. Gibson, petitioner, a candidate for *464the Democratic nomination for commissioner of the County Court of Calhoun County at the primary election held, on May 13, 1952, sought a writ of mandamus directing Clarence O. Bower, Foster Poling and Kenneth Hall, commissioners of the county court of that county, and as such, ex officio, the board of canvassers, defendants, hereinafter referred to as “board”, to reconvene and to reject 117 ballots cast by absentee voters and counted by the board, for the reasons that,…
