Bell, Judge:

William L. Oswald brought this action to recover payment for compensatory time he accumulated prior to his resignation as a deputy sheriff for Aiken County. A jury returned a verdict of $5,684.98 for Oswald. The County appeals. We affirm.

Oswald served as a deputy sheriff for Aiken County from 1976 until early 1979. After an intial period of service he was assigned to the mobile crime lab where he was responsible for processing all major and minor crime scenes within the County.
