In Equity. Bill by the National Bank of Goldsboro, trustee, and others, against E. W. Hill, trustee of the Wayne Furniture Company, bankrupt, for the recovery of the proceeds of the property of the bankrupt in the possession of the trustee. Decree against defendant for part of the relief sued for.

The facts, disclosed by the pleadings and proof, iu respect to which there is no substantial controversy, are:
The Anclrews-Waddcll Furniture Company, a corporation, was engaged iu Lniving and selling furniture in the city of Goldsboro, N. C., prior to January, 1912. The stock was sold to J. F. White and others, who organized the Wayne Furniture Company, with a capital stock of $5,000, taking over the assets and assuming the payment of the debts of the Andrews-Waddell Furniture Company.
