Cole v. Cole's Estate

Case made from Wayne; Donovan, J. Carrie Cole petitioned the probate court for an allowance for her support, and for the support and education of her children, out of the estate of Darius Cole, deceased. The probate court made an order for a less amount than was claimed, and petitioner appealed to the circuit court, where she prevailed. The executors, Adelbert R. Lee and Robert Maxwell, assign error.

This is an appeal by the executors of Darius Cole, deceased, from an order of the circuit court directing the payment by them of the sum of $4,000 per year for the support and maintenance of Carrie Cole, widow of the son of the deceased, and for the support and education of her children. It appears that Darius Cole died testate, leaving a son, Frank D. Cole, his sole heir. The ninth clause of the will reads:
