Appeal from a judgment of the Supreme Court (McNamara, J.), entered December 12, 2000 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of respondent Board of Parole revoking petitioner’s parole.

After his release from prison to parole supervision and the transfer of that supervision to Georgia, petitioner was arrested on charges of burglary and arson in Georgia. He subsequently entered a plea of guilty to the charges, was sentenced to a period of probation and was returned to this State for a final parole revocation…
