McDOWELL, District Judge.
This was a prosecution under section 5209, Rev. Stat. (U. S. Comp. St. 1901, p. 3497), for a violation committed in Dickenson county, Va. A mistrial was had at the August term of the court at Big Stone Gap. Upon withdrawing a juror, ón the motion of the government and over the objection of the defendant, the case was ordered transferred to Abingdon for trial at the succeeding October term. The reasons for making the’transfer need not be stated at great length. It developed during the trial that there was at Big Stone Gap among sundry of the citizens a strong sentiment…
