ORDER

MILLS, District Judge.

This cause comes before the court on the motion of defendant Chickasaw Equipment Company (“Chickasaw”) to dismiss it as a defendant in this action. The court concludes that the motion is well taken and should be granted. :■

This action involves products liability claims asserted by plaintiff Bill Lott and his wife Alycia, arising out of an all-terrain vehicle (ATV) accident in which Bill was injured. Plaintiffs filed suit in the Circuit Court of Oktibbeha County on July 26, 2004, and the case was removed to this court on the basis of diversity jurisdiction. 28 U.S.C.…
