In this case the appellant was indicted for the theft of two hogs, the property of one Austin Bose, and was tried and found guilty, and his punishment assessed at two years in the penitentiary.
The principal errors complained of were: 1st, error in the charge of the court; and, 2d, that the verdict of the' jury was contrary to the weight of the evidence.
We will notice the last ground of complaint first.
