Emma Pierce, in an equitable petition against Hattie Lou Montgomery and six other individuals, stated the following case:

Frank Pierce, Sr., died intestate on November 28, 1916, and in Item 3 of his will he devised to his wife, Hattie Pierce, for and during her life, a described parcel of land, as well as all of his personal property, and in the following item he devised the same real estate, on her death, to his four children, Frank Pierce Jr., Hattie Pierce, John McNeill Pierce, and Annie Speaker Pierce, “and to no other, except hereinafter provided in special legacies and…
