The question raised by assignment of error will be determined by the construction given to the several statutes relating to the State Treasurer, and regulating his duties, &c. By the schedule to the constitution (section 2), all laws then in force, in the Territory of Arkansas, not repugnant to the constitution, should remain in force until they expired by their own limitation, or be altered or repealed by the General Assembly; and section five, declares that, “All civil and military officers then holding commissions under the authority of the United States, or of the Territory of Arkansas,…
