I. The respondent makes the point at the outset, that there is nothing before the court to consider, because the motion for new trial was not made withiu four days after the entry of the judgment. No motion for new trial is necessary to raise the question upon which our judgment is ■invoked, whether the petition states a cause of action, which question is presented by what is termed the record proper.
