Fox, Judge:

W. H. Hess died on the 8th of April, 1928, leaving surviving him Ethel Hess, his widow, Claude A. Hess and Mabel Hess Luring, adults, and Cleopas R. Hess and Charles W. Hess, infants, his only heirs at law. On May 21, 1928, Claude A. Hess qualified as administrator of his estate. On July 31, 1928, seventy-one days after the qualification of the administrator, one T. W.
