Reversing.
On February 23, 1927, the Proctor Coal Company was operating a coal mine in Whitley county and had not accepted the provisions of the Workmen’s Compensation Act (Ky. Stats. Secs. 4880-4987). J. W. Hall was a miner in its service and was injured in the mine. He brought this suit to recover for his injuries on January 5, 1928. Among other things the defendant pleaded that after his injuries Hail had been sent to an infirmary and the defendant had paid his expenses and doctor’s bill and furnished money to him, amounting in all to $1,531.97,…
